Once convicted of domestic assault, and if charged again in the future, the potential punishment is enhanced by law. A second offense carries a minimum $350 fine and at least 30 days in jail, while a third or subsequent offense carries a minimum fine of $1,100 up to $5,000, and at least 90 days in jail.
A third or subsequent offense, where the alleged victim is (1) a current or former spouse, (2) a current or former sexual partner, or (3) a related minor child, can be enhanced to a class E felony (range of 1 – 6 years) if both of the underlying convictions involved assault with bodily injury.
